Buganda Road Court granted him bail after he was arrested in downtown Kampala on May 24, 2022 during a protest against high commodities prices.
Besigye, on the other hand, denied the bail and, through his lawyers Chrysostom Katumba and Kampala Mayor Erias Lukwago, requested that it be reviewed.
The FDC founding president appeared before the High Court Civil Division on Monday morning for a decision on his bail review appeal.
In his judgement, Judge Elubu stated that the Shs 30 million bond issued by Buganda Road Court for Besigye was severe and unreasonable given the circumstances of the case.
He noted that the offence of incitement to violence carries a possible term of three years in prison and a fine of $1,240,000, therefore the bail restrictions couldn’t be so strict.
Elubu adds that exorbitant bail money terms make bail appear to be a punishment, despite the fact that its aim is to persuade the accused to appear in court for trial.
The judge further noted that Besigye was arrested and accused alongside three other people, all of whom were released on non-cash bail, and that his driver, Fred Kato, was given a cash bail of one million shillings.
